Welcome to Nestwise. These Terms & Conditions apply to your use of the Nestwise website and to the purchase, download and use of products and resources sold or supplied by Nestwise.

By accessing this website, placing an order, purchasing or downloading a Nestwise product, you agree to these Terms & Conditions.

Throughout these terms, “Nestwise”, “we”, “us” and “our” refer to Nestwise. “You” and “your” refer to the person accessing our website or purchasing or using our products.

1. About Nestwise

Nestwise provides educational resources designed to support parents and caregivers with clear, practical and evidence-informed information relating to newborn and child health, wellbeing, common illnesses and minor injuries.

Nestwise resources are created by a registered paediatric nurse and are designed to help parents and caregivers better understand common health concerns, recognise signs that may require medical assessment, and feel more informed when deciding what to do next.

2. Medical Disclaimer

All information contained in Nestwise physical products, digital products, downloadable resources, website content, social media content and other educational materials is provided for general educational and informational purposes only.

Nestwise information is not individual medical advice and is not intended to diagnose, treat, cure or prevent any illness, injury or medical condition.

Our resources do not replace assessment, diagnosis, treatment or advice from a doctor, nurse practitioner, registered nurse, pharmacist or other appropriately qualified healthcare professional.

Every child and clinical situation is different. General educational information cannot take into account all factors relevant to an individual child, including their age, medical history, underlying conditions, medications, allergies, symptoms, clinical examination or other individual circumstances.

6. Products and Availability

We aim to describe and display our products as accurately as reasonably possible.

Product colours, dimensions, packaging and appearance may vary slightly from photographs displayed online due to screen settings, manufacturing processes, photography or subsequent product improvements.

We reserve the right to update, modify, discontinue or limit the availability of products where reasonably necessary.

7. Orders and Payment

All prices are displayed in New Zealand dollars (NZD) unless otherwise stated.

Payment must be received in full before an order is processed.

You are responsible for ensuring that the information provided when placing an order, including your email and delivery address, is complete and accurate.

We reserve the right to decline or cancel an order where we reasonably believe there has been a pricing or technical error, fraudulent transaction or other legitimate issue.

Where we cancel a paid order, the relevant payment will be refunded.

8. Shipping and Delivery

Physical products will be shipped according to the shipping options and estimated delivery timeframes displayed on our website.

Delivery timeframes are estimates and may be affected by courier delays, public holidays, weather, supply disruptions or other circumstances outside our reasonable control.

Returns, replacements and refunds are handled in accordance with our Returns & Refunds Policy and applicable New Zealand law.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or other applicable New Zealand legislation where those rights or remedies cannot lawfully be excluded or restricted.

10. Digital Products

Nestwise digital products are licensed to the purchaser for personal and household use only unless expressly stated otherwise.

Digital products must not be:

  • shared with others;

  • uploaded to shared drives, websites, social media platforms or online groups;

  • reproduced or distributed;

  • resold;

  • used commercially;

  • substantially altered and represented as a Nestwise resource; or

  • used to create or develop a competing commercial product.

Due to the nature of digital products, change-of-mind refunds may not be available once a digital product has been supplied or accessed, subject always to rights available under applicable New Zealand consumer law.

Unless otherwise stated, all intellectual property associated with Nestwise is owned by or licensed to Nestwise.

Purchasing a Nestwise product does not transfer ownership of the intellectual property contained within that product.

Nestwise content must not be copied, reproduced, republished, distributed, adapted, sold or used commercially without prior written permission, except where permitted by law.

We aim to maintain accurate and functional website content but cannot guarantee that the website will always be uninterrupted, error-free or available.

Unless expressly stated otherwise, Nestwise does not control these third-party services and is not responsible for their availability, content, privacy practices or services.

13. General Limitation of Liability
